Pašlaik ir svarīgi izvērtēt Latgales apgabaltiesas spriedumu lietā par īpašumtiesībām uz naftas vadā Polocka–Ventspils esošo bufernaftu, un nav izslēgts, ka pēc tam šis jautājums tiks atkārtoti skatīts valdības sēdē, sacīja Ekonomikas ministrijas (EM) Sabiedrisko attiecību nodaļas vadītāja Evita Urpena.

Viņa atgādināja, ka valdība gan 2010.gada, gan 2011.gada beigās vairākkārt diskutējusi par to, kam pieder īpašumtiesības uz bufernaftu, kas atrodas holdingkompānijas "Ventspils nafta" meitasuzņēmuma "LatRosTrans" naftas vadā Polocka–Ventspils, kā arī analizējusi iespējas valstij pierādīt savas īpašumtiesības uz to.

Šim nolūkam 2011.gadā tika izveidota darba grupa, kas izvērtēja visus pieejamos dokumentus, un secināja, ka valstij nebūtu iespējams pierādīt, ka bufernafta tai pieder. Darba grupa un Ministru kabinets izvērtēja arī dažādu citu ekspertu atzinumus, taču neviens no tiem nesniedza nepieciešamo pamatojumu apgalvot, ka īpašumtiesības uz bufernaftu ir valstij, un līdz ar to izvirzīt attiecīgu prasību tiesā.

"Pašlaik ir svarīgi izvērtēt tiesas lēmumu un noskaidrot, vai tiesas procesā nav gūta informācija, kas varētu liecināt par valsts īpašumtiesībām uz minēto naftu. Pieļaujams, ka pēc sprieduma izvērtēšanas šis jautājums atkārtoti tiks skatīts Ministru kabineta sēdē," sacīja Urpena.

Pēc viņas teiktā, kamēr nav gūti papildu pierādījumi, valdības pozīcija paliek nemainīga – valsts rīcībā pašlaik nav pamatoti pierādījumi, ka bufernaftas īpašumtiesības pieder valstij, līdz ar to izvirzīt prasību tiesā būtu neefektīvi.

Latgales apgabaltiesa ]]> 9.decembrī pilnībā ]]> noraidīja Baltkrievijas uzņēmuma prasību pret "LatRosTrans" par īpašumtiesību atzīšanu uz Latviju šķērsojošajā maģistrālajā naftas cauruļvadā esošo tehnoloģisko naftu. Pilns sprieduma teksts bija pieejams no 30.decembra.

Cauruļvada Ventspils–Novopolocka īpašniece "LatRosTrans" pērn 25.novembrī sāka tajā esošo naftu pārvietot uz rezervuāru. Šie tehniskie darbi tika veikti, lai nākotnē būtu iespējams atjaunot cauruļvada darbību. Tas savukārt izraisīja diskusijas par to, kam īsti pieder īpašumtiesības uz bufernaftu.

Kompānija "LatRosTrans" ir naftas un tās produktu maģistrālo cauruļvadu īpašniece un operatore Latvijas teritorijā. 66% kompānijas pamatkapitāla pieder "Ventspils naftai", 34% – "Transņefteprodukt".
